By authorizing an environmental site assessment, signing a consulting agreement, scheduling a compliance inspection, or using our digital client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our environmental consulting services.
We provide comprehensive environmental consulting, engineering, and compliance management services for commercial, industrial, and residential developers. This includes, but is not limited to: Phase I and Phase II Environmental Site Assessments (ESA), soil and groundwater sampling, hazardous materials inspections, remediation planning, and Massachusetts Department of Environmental Protection (MassDEP) regulatory compliance.
The specific scope of our consulting work, engineering deliverables, and laboratory testing for your property will be defined exclusively by a separate, fully executed written consulting agreement.
All environmental consulting proposals and assessment estimates provided by our team are valid for 30 days.
Final consulting costs may vary if unforeseen environmental hazards, undisclosed underground storage tanks (USTs), or severe soil contamination are discovered during our initial site assessment.
Any major deviations from the original consulting scope that require additional laboratory testing or extended remediation planning require a formal, written change order approved by the Client before additional work proceeds.
Clients are strictly responsible for funding their consulting projects according to the payment schedule outlined in their specific contract.
Retainers or deposits are generally required before our environmental engineers begin fieldwork or order specialized laboratory testing.
In accordance with state law, we reserve the right to suspend consulting services or withhold final environmental assessment reports for accounts materially in arrears.
The Client agrees to provide our environmental consultants, engineers, and authorized subcontractors with safe, unobstructed access to the property during scheduled evaluation hours.
The Client is strictly responsible for securing the site and ensuring that all necessary keys, gate codes, or facility managers are available prior to our arrival for environmental sampling or inspections.
While we strive to adhere to estimated consulting timelines, all outdoor environmental sampling and site evaluation dates are approximate.
The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe New England weather conditions (e.g., heavy rain or frozen ground that makes soil boring or groundwater sampling scientifically inaccurate or unsafe).
During active environmental sampling or hazardous materials inspections, Clients and their representatives must maintain a safe distance from our testing equipment and personnel at all times.
All assessment tools, drilling rigs, and testing equipment provided by the Company or our subcontractors are to be operated exclusively by trained and licensed staff wearing appropriate Personal Protective Equipment (PPE).
You agree to accurately identify property lines and authorize site evaluation work only if you are the legal owner or authorized representative of the site.
Crucially, the Client is responsible for disclosing all known prior uses of the property, historical spills, and the location of all private underground utilities prior to any invasive soil testing.
The Company is explicitly not responsible for damage to unmarked private subterranean lines during environmental soil boring. We will contact Massachusetts Dig Safe (811) for public utility locates as required by law prior to any excavation or deep soil sampling.
The Company maintains comprehensive professional liability insurance. Our environmental assessments and consulting reports are based on professional judgment and the data reasonably available at the time of the inspection.
However, to the fullest extent permitted by law, our aggregate liability arising out of any environmental consulting project is strictly limited to the direct cost of the consulting fee paid to us.
We are explicitly not responsible for pre-existing environmental contamination, regulatory fines imposed by the EPA or MassDEP prior to our engagement, or any indirect, incidental, consequential, or punitive damages.

You agree to fully indemnify and hold harmless CORNERSTONE CONSTRUCTION SERVICES LLC, its consultants, and staff from any claims, damages, or liabilities arising from your material misrepresentation of property history, failure to disclose known environmental hazards, or failure to disclose private underground utilities prior to sampling.
If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
